PURCHASES AND PAYMENT

You authorize Us to charge your chosen payment provider for the total amount stated on Your checkout cart screen. You agree to abide by the terms and conditions of Your card issuer agreement and any other applicable third party agreement that may affect Your purchase with Us. You agree to provide current, accurate and complete details as requested to process your payment. If necessary, You agree to update your payment information in a timely manner so We can complete any outstanding orders and/or contact You as needed.

We reserve the right to change our prices for new purchases at any time.

You agree to pay any applicable shipping and/or handling fees as stated on your checkout cart screen.

ERRORS OR MISTAKES IN PRICING

We reserve the right to correct any errors or mistakes in pricing, even if We have already received payment. Any such changes will be conveyed in writing via email to notify You of Our correction and to allow You to take the most appropriate action in the event of such a correction or mistake.

REFUNDS AND RETURN POLICY

Due to the nature of the services and/or products provided, refunds will not be given unless otherwise specified in writing.

PROMOTIONAL PRICING DEVICES AND PRICE ADJUSTMENTS

We are not able to accommodate a price adjustment after Your purchase.

USE OF IMAGE

The Photographs produced by Dragonfly are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Dragonfly’s written permission. Limited copyright ownership of the Photographs are transferred to Client upon delivery of the Gallery to Client by Dragonfly. Dragonfly grants Client permission to share the Photographs only for personal use, including, but not limited to, use for display on personal websites, sharing with family and friends, social media for personal use and printing unlimited prints of any size for personal use. As otherwise specifically provided herein, all Photographs and rights therein, including copyright, remain the sole and exclusive property of Dragonfly. Any additional uses not listed in this Contract require the prior written consent of Dragonfly on the terms to be negotiated. Unless otherwise provided herein, any grant of rights is limited to the private use of the Photographs purchased by the Client and are prohibited from all commercial uses. Oona Breyer and Dragonfly are the owners of the copyright of all images captured on the event date which includes, but is not limited to; photography, time lapses, videography, photo booth and/or second shooters. This agreement holds as long as the Client does not publish or sell the images for profit.

Client grants Dragonfly the irrevocable unrestricted right to copyright, use and publish the Photographs of the Client, the Party and/or Event guests, for commercial, editorial, promotional, trade, educational, competition and/or other purposes and in any manner and medium, to alter the same without restriction, without compensation or liability to Client.

Dragonfly will take photo or video images, or, with proper approval from another vendor, may use video images taken by another vendor, (“Images”) of the Party and Event guests and may use one or more of the Images on Dragonfly’s website and/or social media platforms. Client understands and consents that Dragonfly’s use of the Images where Client appears may constitute a use of Client’s persona (constituting name, social media names, signature, photos, images, likeness, or distinctive aspect of Client’s appearance) for commercial and marketing purposes.

. SCOPE OF WORK

Dragonfly will perform portrait and/or event photography services (“Services”) for the benefit of Client for a particular session(s) (the “Event”).

Client understands and agrees that any and all proofs, sample prints, images and digital images (“Photographs”) remain the property of Dragonfly.

Dragonfly employs and contracts a team of multiple photographers, consisting of both primary photographers (“Primary Shooter”) and secondary photographers (“Secondary Shooter”) (collectively with any assistants, the “Photography Team”). 

A Primary Shooter is the only photographer for portrait photography. Dragonfly will use reasonable effort to inform Client who his/her/their Primary Shooter is at least Four (4) weeks before the Event. If Dragonfly must change the Primary Shooter, Dragonfly will use all reasonable effort to inform Client of the new Primary Shooter as soon as reasonably possible, in accordance with Article 6 below.

Dragonfly reserves the right to edit and will be the final authority on the Photographs that will be offered to Client or delivered in the online wedding/Client gallery (the “Gallery”). Final images will be available in high-quality JPG format only, and no RAW images will be made available at any point to Client. After the Event, all Photographs will be processed and selected at the sole discretion of Dragonfly. The editing of the Photographs is at the sole discretion of Dragonfly. Special editing requests must be made and approved in writing by Dragonfly at a minimum of Thirty (30) days prior to the Event. Special editing requests include removing tattoos, smoothing scars, changing the appearance of any person (double chins, making a person thinner etc.), and any other requests made by Client which Dragonfly concludes will require editing time beyond what is normally allotted for clients. Culled out, unedited files will never be delivered to a Client. Creative decisions with any of Client’s Photographs and videos such as shooting, editing styles, cropping, music, and artwork are at the sole discretion of Dragonfly. Additional special editing requests, specific or extensive retouching, changes or revisions can be purchased at One Hundred Dollars ($100) per hour.

Upon receipt of the Gallery and image downloads, Client accepts all responsibility for archiving and protecting the Photographs. Dragonfly does not permanently archive Photographs. Dragonfly is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to view Photographs. It is Client's responsibility to make sure that digital files are copied to new media as required. Dragonfly will archive all edited Photographs for One (1) year.

Every reasonable effort will be made to take requested photographs, but no specific pose or photograph is guaranteed. Any lists and/or requests supplied will be used for organizational purposes only. Images determined by Dragonfly to be substandard or duplicated may be edited out. Dragonfly will use its professional judgment and sole, reasonable discretion to select which Photographs to deliver. Such selection shall constitute all images that will be made available to Client.

CHARGEBACKS

​​You agree to make every attempt to file a refund prior to attempting a chargeback with Your financial institution. In the event of a chargeback attempt, You expressly agree to forfeit any and all of Our bonuses, affiliate bonuses, or other materials afforded to You in exchange for Your original purchase of Our Offering. We reserve the right to present proof of Your access and these Terms and Conditions of Use to the financial institution investigating the dispute.

REVOCATION​ ​OF​ ​ACCESS

​You have the unilateral right to terminate Your use and access to any of Our Offering(s). Please send an email to Us to initiate this process. Termination will not excuse You of further payment. Upon confirmation of Your termination, any and all outstanding balances will become immediately due and payable. Any existing balance that remains after 14 days from the date of termination will be sent to a collections agency, and You agree to be responsible for any additional charges, fees, or costs associated with such a collection effort, including but not limited to reasonable attorney’s fees and court costs.

CURRENCY

All payments will be processed in the local currency, or if not specified at checkout, in US Dollars.

TAXES

Sales taxes will be applied to your order as required by law in either Your or Our local area(s).

ORDER REVERSAL OR CANCELLATION

We reserve the right to refuse to fulfill any order placed on Our website, in part or in full, and will issue a refund accordingly. We reserve the right to limit or cancel quantities purchased by any given user or household at our sole discretion.
